Gappa <br />Title Director of Public Services <br />Administrator Reviewed:Agenda Section: <br />City Administrators's Report <br />Item Description: Driveway for 4051 Highwood Road- Resolution <br />We are in the process of designing a project to install a new storm sewer pipe to replace an existing <br />pipe that is failing. This existing pipe drains an area adjacent to Highwood Road to Lake <br />Minnetonka. This failing pipe has been causing flooding problems in several yards and threatening <br />a home basement. The proposed project is to directional bore a new pipe from the ponding area <br />adjacent to Highwood Road along a 20 foot wide platted alley to Lake Minnetonka. A project plan <br />is included for your review. The pipe will be directionally bored, so no excavation will be required <br />for pipe installation under the road and down the hill. Excavation w ill be required near the lakeshore <br />to install a manhole and a short section of pipe. Riprap will be installed at the lakeshore. In order <br />to protect the hill side, the contractor will be required to barge in the necessary materials and <br />equipment across the lake to complete the work near the lakeshore. The proposed plan is to solicit <br />quotations for this project and then present them for Council consideration at the May 13"* Council <br />meeting. This cost for this project is less than the $50,000 threshold for advertising for sealed bids <br />and soliciting quotations will reduce the project administrative costs. <br />Because of the narrow width of the alley, we w ill need to obtain a "Right of Entry" to enter the <br />property at 4051 Highwood Road in order to complete the work near the lakeshore. We have had <br />several meetings with the property owners, Alex and Edith Vongries, to discuss obtaining a right of <br />entry across their property to allow for completion of this project. The property owners are generally <br />supportive of the project and recognize the need to complete this project. <br />During the meetings to with the property owners to discuss this project, the)’ expressed concerns <br />about the status of the portion of their driveway that has been located on the platted alley since 1983 <br />when the previous owners constructed a replacement garage and driveway for the property. The <br />house on the property was constructed sometime prior to 1970. The property owners are planning <br />for a future sale of this property and are concerned about the lack of an explici* Council action <br />approving the driveway on the platted alley. They are interested in obtaining an official Council <br />resolution approving the driveway that can be recorded on the chain of title for the property. <br />We have reviewed this situation and are recommeiiding approval a resolution granting permission <br />for this driveway to remain on the platted alley.
