A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE SECTION 10.24, <br />SUBDIVISION 5 (B) AND SECTION 10.55, <br />SUBDIVISION 8 <br />HLE NO. 02-2745 <br />WHEREAS, Ilona Peterson and Kenneth Peterson, (hereinafter "the applicants") are <br />owners of the property located at 1074 Wildhurst Trail within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />Lot 4, Block 1, Wildhurst Estates, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicants have applied for variances to Municipal Zoning Code <br />Section 10.24, Subdivision 5 (B) to permit construction of an attached garage 17.76' to the street <br />property line where 35’ is required, and to permit construction on a property less than one acre in <br />size; and to Section 10.55, Subdivision 8 to permit land alteration and construction of a garage and <br />enclosed walkway within the 26 ’ wetland buffer; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on February 19, 2002 and March 18. 2002, at which time all <br />persons desiring to be heard concerning this application were given the oppt^rtunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #02-2745. <br />2. The property is located in the LR-1B, Single Family Lakeshore Residential Zoning <br />District where 1 acre is the minimum lot size and 140 feet is the minimum lot width. <br />Page i of 6
