The City’s Flood Plain and Wetlands Management ordinance <br />(Section 10.55) does not permit filling, grading, excavation, hardcover, and structures within a <br />protected wetland and within 26' of the edge of the wetland. A variance is also required to permit <br />the garage to be located 17.76 ’ from the front propert> line, where a 35’ setback is required. <br />fhe garage is a two level building with driveway access to each level. The two level garage <br />requires less building mass on the property as a traditional one story-four stall garage Is difficult <br />to fit on the site due to the wetland location. <br />The property owners had done their original house design based on wetland information that was <br />determined in 1991 before the Wetland Conservation Act rules for delineation were established. <br />In 2002. determination of a wetland boundary must be completed by methods required by the <br />Wetland Conservation Act. The new wetland boundary was determined to be significantly larger <br />than was found in 1991 causing the house to be located within the new wetland setback. A <br />variance to permit new construction on the property of less than I acre is now required, as the <br />e.xpanded delineated wetland area has reduced the dry buildable area to less than one-acre. <br />To accommodate for the lost buffer area the property owners have mitigated an area totaling <br />2,180 s.f as additional wetland and buffer area on the property. The total amount of buffer area <br />being impacted by the project is approximately 1,500 s.f.
