ORDINANCE NO. 159 SECOND SERIES 1 i 20Q2 <br />CITY Or vrivrt»o <br />AN ORDINANCE EXTENDING AN INTERIM MORATORIUM <br />ON THE GRANTING OF BUILDING PERMITS, LAND SUBDIVISIONS, <br />REZONING APPLICATIONS, CONDITIONAL OR SPECIAL USE PERMITS, <br />VARIANCES OR OTHER AUTHORITY RELATING TO THE SITING OF <br />WIRELESS TELECOMMUNICATIONS FACILITIES AND STRUCTURES <br />IN ALL ZONING DISTRICTS IN THE CITY OF ORONO <br />The City Council of Orono does ordain: <br />SECTION 1. Statement of Policy . ThepurposeofOronoMunicipalCodeChapter lOistoprovideforthe <br />orderly development of commercial and industrial activity so as not to unreasonably conflict with the primary <br />residential and agricultural character of the City. <br />SECTION 2. Extension of Interim Moratorium . To facilitate the purpose stated in Section I the City <br />Council on November 13,2001 imposeda 1 20 day interim moratorium, pursuant to Minnesota Statute Section <br />462.3SS, Subdivision 4, on the granting ofbuilding permits, land subdivisions, rezoning applications, conditional <br />or special use permits, variances, or other authority relating to the siting of wireless telecommunication <br />facilities and structures in all zoning districts in the City of Orono. This moratorium was imposed to allow the <br />City time to study the issues relating to telecommunications structures and to make any necessary changes <br />in its current ordinances. Because the City has not yet completed the study of telecommunications zoning <br />issues, this moratorium is hereby extended to _____________________. <br />SECTION3. Telecommunications Facilities. ForthepurposesofthisSectionthewordsusedhereinshall <br />have the following meaning: <br />I. Telecommunication - the wireless transmission, emission or reception of energy or <br />communication impulses by cable, microwave, satellite or radio signals affecting radio, <br />telephone, telegraph or television communication or medical or industrial energy <br />transmissions. <br />2. Facility - any antenna, tower, or structure associated with the transmission, emission or <br />reception of telecommunication signals. <br />SECTION 4. Effective Date.
