1 <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.56, SUBDIVISION 16 (CKl), <br />SECTION 10J6, SUBDIVISION 16 (CK6), <br />SECTION 10.56, SUBDIVISION 16 (L)(l); <br />FILE NO. 01-2709 <br />WHEREAS, Richard R. Shull and Anne M Shull (hereinafter "the applicants'*) are <br />the owner’s of the property located at 2285 French Lake Road within the City of Orono (hereinafter <br />"the City") and legally described as follows: <br />Lot 4, Block l,and Outlot C, Johnston ’s French Lake Second Addition, Hennepin <br />County, Miimesota (hereinafter “the property ’’); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.56, Subdivision 16 (C)(1) to permit structure within 150' of a Natural <br />Environment Lake, Section 10.56, Subdivision 16(L)(1) to permit 3,622 s.f. (22.25%) of hardcover <br />in 0*75' setback area where 4,381 s.f. (26.9%) exists and 0 s.f. (0%) is allowed and Section 10.56, <br />Subdivision 16(C)(6) to permit the encroachment of 50’ and 75' into the average lakeshore setback <br />for construction of a two stall garage to the east end of the residence and a new entryway over <br />existing steps. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 17,2001, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Mirmesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1.
