(1.5 acres) <br />List of Exhibits: <br />A Resolution <br />B Staff Report and Exhibits of 9/17/01 <br />Application Summary*: The applicant is seeking approval to construct a two stall garage (S76 s.f.) <br />to the east end of the residence and a new entry-way (80 s.f) over existing steps. Both the addition <br />and entry way are within 150' of a Natural Environment lake. <br />The proposed garage will be located over existing driveway. The applicant is proposing to remove <br />approximately 800 s.f of driveway that will no longer be needed. The existing garage will be turned <br />into a screen porch, office, laundry room and storeroom. <br />The lot was developed in 1979 prior to the adoption of the Shoreland Ordinance (1992). The <br />Shoreland Ordinance created a 150' structure setback from French Lake, whereas only a 26’ wetland <br />setback was required before 1992. French Lake was considered as merely a wetland before it was <br />redesignated as a Natural Environment Lake by the Shoreland Ordinance. The ordinance was <br />adopted by Council with the understanding it would create non-conforming lots in the French Creek <br />Subdivision. The subject property owner ’s house now encroaches into the required 150' setback. <br />1. Section 10.56, Subdivision 16 (C)( 1): Structural setbacks for Natural Environmental Lakes( 150'): <br />To permit an addition to the east end of the residence and an entry way over existing steps. <br />2. Section 10.56, Subdivision 16 (L)(l): Hardcover in 0-75 ’: To allow 3,622 s.f (22.25%) of <br />hardcover where 4,381 s.f (26.9%) exists and 0 s.f or 0 % is allowed. <br />3. Section 10.56, Subdivision 16(C)(6); Average Lakeshore Setback: To allow the additions to the <br />residence to encroach 50' and 75' into the average lakeshore setback. <br />PLANNING CO\LMISS:ONi <br />The Plarming Commission recommended by a 7 to 0 vote to: <br />Approve the application as presented.
