'• A U\1
GITYofORONO
£SH^
RESOLUTION OF THE CITY COUNCIL
NO. 4695,
2.
3.
5.
6.
The proper^ is located in the RR-IB, Single Family Rural Residential Zoning
DistricL where 2 acres is the minimum lot area. The property consists of
approximately l.S acres.
The Orono Planning Commission reviewed this application on September 17,2001
and recommended approval by a vote of 7 to 0.
4. The Planning Commission made the following findings of fact:
A. The 150' Natural Environment lake setback was adopted after the residence
was built.
B Hardcover in the 0-75' setback zone will decrease to 3,622 s.f. (22.25%) from
4,381 s.f (26.9%). .
C. The structural coverage on the property will be 4.9%, below the allowed
15%.
D.Encroachment into the average lakeshore setback will not adversely affect
the neighboring property ’ views.
The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance will not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicant;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
The City Council has considered this application including the findings and
recommendations of the Plaiming Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health, safety and
welfare of the community.
