(1.5 acres)
List of Exhibits:
A
B
C
D
E
F
Letter from Property Owners (Jan 31,2002)
Hardcover calculation revisions
Approved Plans
Resolution #4695
Proposed Plans
Staff Report and Exhibits of 9/1 7/01
Summary of Request:
The City Council adopted, on consent. Resolution No. 4695 for Richard and Anne Shull to grant
variances to permit construction of a two stall garage and a new entry way to an existing one level
residence at 2285 French Lake Road. The garage and entry way addition are within 150' of
French Lake, a Natural Environment lake.
The lot was developed in 1979 prior to adoption of the Shoreland Ordinance (1992). The
Shoreland Ordinance created a 150' structure setback from French Lake, whereas only a 26'
wetland setback was required prior to 1992. French Lake was considered as merely a wetland
before it was re-designated as a Natural Environment Lake by the Shoreland Ordinance. The
ordinance was adopted by Council with the understanding it would create non-conforming lots in
the French Creek Subdivision. The applicants residence currently encroaches into the required
150* setback.
The applicants builder. Bob Boyer, applied for a building permit. The garage and entry way on
the plans were larger than what was approved. Also, different is a floor to ceiling bay window.
The garage, entry way and bay window are all located in the 0-75' setback zone. The 0-75'
setback hardcover is increasing from what was approved but still less than what currently exists.
The following changes were noted on the plans submitted.
Approved garage - 24' x 24'.
Proposed garage - 24' x 32'.
Approved Entry way - 7' x 11 ’.
Proposed Entry way - 8' x 16'.
i
\
