The amount of hardcover in ihe O' to 75’ lakeshore setback would be <br />reduced from 20% to 15.3%. <br />4.The City Council finds that the conditions e.xisting on this prcpert>- are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions” light, filr nor <br />pose a fire hazard ot other danger to neighboring prope;tj; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preset^-e a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent ot the Zoning Code and Comprehensive Plan of the City. <br />0.The City Council has considered this application including the findings and <br />recommendations of the Plarming Commission, repons by City- staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 and 2 to allow the <br />remodeling and expansion of the existing residence located 34' from the OHWT where 75' is <br />required and hardcover of 4,415 s.f. (15.3%) in the 0’ to 75’ lakeshore setback where 5,815 s.f <br />(20%) is e.xisting and none is allowed. <br />1.All plastic under landscaping must be removed in the 0* to 75' lakeshore setback <br />prior to any new construction. <br />No further variances will be granted to this property in the future. <br />j.Authorities granted by this variance tun with the property* not with the applicants, <br />but are permissive only and must be e.xercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (October 25, 2000). <br />Page 2 of 5 <br />.
