CITYoTORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 69 8. <br />2. <br />3. <br />5. <br />6. <br />The property is located in the RR-IB, Single Family Rural Residential Zoning <br />District, where 2 acres is the minimum lot area. The property consists of <br />approximately l.S acres. <br />The Orono Planning Commission reviewed this application on September 17,2001 <br />and recommended a^nroval by a vote of 7 to 0. <br />4. The Plaxuiing Commission made the following findings of fact: <br />A. The 150' Natural Environment lake setback was adopted after the residence <br />was built. <br />B.Hardcover in the 0-75' setback zone will decrease to 3,622 s.f. (22.25%) from <br />4,381 s.f. (26.9%). . <br />C. The structural coverage on the property will be 4.9%, below the allowed <br />15%. <br />D.Encroachment into the average lakeshore setback will not adversely affect <br />the neighboring property views. <br />The City Council finds that the conditions existing on this property are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variance will not adversely affect traffic conditions, light, air, nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicant; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicants and the efiect of the proposed variance on the health, safety and <br />welfare of the community. <br />Page 2 of 5 <br />â– Lim . t*r ^
