I <br />The garage was approved with a previous variance fo be located only 9' from <br />the property line. <br />C.Property owners could construct additional accessory buildings on the <br />property without requiring variances. An addition to the existing garage <br />would not require additional buildings on the property. <br />D.The building addition is not within a required yard setback. There is no <br />change proposed for the portion of the building located 9' from the property <br />line. <br />The City Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district; that granting the <br />variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard <br />or other danger to neighboring property; would not merely sen e as a convenience to <br />the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />Citv. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicant and the effect of the proposed variance on the heal th, safety and w el fare <br />of the community. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants <br />variances to Municipal Zoning Code Section 10.22. Subdivision 1 (B) and Section 10.56. <br />Subdivision 16(C) (6) to permit an encroachment into the average lakeshore setback to permit a 10 ’ <br />addition to the kitchen and mud room to the principal residence, and a variance to Section 10.03. <br />Subdi\ ision 9 (E) to permit an addition to the detached garage located 9’ from the street property <br />line, where a 15’ setback is required subject to the following conditions: <br />1 . The detached garage shall not exceed 1,000 s.f. <br />2. The property shall be developed in conformance w ith the site plan attached as Exhibit <br />A. <br />Page 3 of 6
