Ml of a lakeside porch which is located 2.7' from side lot line. Section 10.03, Subdivision 1(B) to permit the porch to encroach 67’ into the average lakeshore setback. Section 10.22, Subdivision 2 and Section 10.56, Subdivision 1 (L)( 1) to permit 297.2 s.f. (7.5%) of hardcover in the 0-75' setback area where 297.2 s.f. (7.5%) e.xists and 0 s.f. (0%) is allowed. Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16(L)(2) to permit 2,351.67 s.f. (25.6%) of hardcover in the 75-250' setback zone where 2,35 1.67 s.f. (25.6%) exists and 2.292.38 s.f. (25%) is allowed, and Section 10.22, Subd. 1 (B) to permit structure within 75’ of the lakeshore . Approval is subject to the follow ing conditions: I.Council approval is based on the site plan submitted by the applicant attached to this resolution as Exhibit A. Any amendments to the site plan may require further Planning Commission and City Council review. Authorities granted by these variances run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit w ithin one year of the date of Council approval, or these variances will expire on that date (January 28. 2003). 3.Violation of or non-compliance with any of the terms and conditions of these variances shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4.The undersigned applicants have read, understood and hereby agree to the temts of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property.
