A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTIONS 78-330 (B), 78-282, AND 78-1288 (B) <br />FILE NO. 03-2943 <br />WHEREAS, Robert Labalt and Janet Labalt, husband and wife, <br />(hereinafter “the applicants”) are the owners of the property located at 3202 North Shore <br />Drive within the City of Orono (hereinafter the “City”) and legally described as follows; <br />That part of the West 57.3 feet of the East 115.05 feet of Government Lot 1, <br />Section 8, Township 117 North, Range 23 West of the 5 “’ Principal Meridian, <br />lying North of County Road No. 51 and lying southerly of a line running West at <br />right angels from a point in the East line of said 57.3 feet distant 165 feet north of <br />the North line of said road. <br />(hereinafter the “property”); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for variances to Orono Municipal Zoning Code Sections 78-330 (b), 78-282, and 78-1288 <br />(b) in order to construct an attached tuck under garage with 2 stories of living space <br />above on the walk-out side of the home attached to the existing one story walk-out home. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Miruiesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #03-2943. <br />The property is located in the LR - IB One Family Lakeshore Residential <br />district, which requires a minimum lot area of 1 acre. The applicant's <br />property is 0.223 acres in size. <br />3.The Planning Commission reviewed this application at a public hearing <br />held on September 15, 2003 and recommended denial. Tlie application <br />was heard by the City Council on October 27, 2003 and was tabled to <br />allowed redesign in accordance with the Planning Commission ’s <br />recommendations. <br />Page 1 of 5
