Hardship: <br />The applicants have included their statement of hardship in Exhibit B. The applicants should also <br />be asked for their testimony regarding this issue. <br />Issues for Consideration: <br />1 . The deck has existed for many years in the location of the proposed deck; <br />2. Replacement of the deck as it currently exists and enclosing a small area will not increase <br />the lot coverage by structure, hardcover in the 75’-250 ’ hardcover zone or change the <br />average lakeshore setback; <br />3. A building permit was issued in 1993 for a second story addition to the home w ithout <br />addressing hardcover or structure issues on the property since the addition did not expand <br />the existing footprint. The deck was not included in the permit; <br />4. The deck would continue to provide a landing for two sliding glass doors located on the <br />lakeside of the house; <br />5. The neighbors’ views of the lake are not greatly affected by the location of the deck or the <br />proposed patio enclosure; <br />6. The plastic hardcover is not permitted by the City anywhere on the property; <br />7. It is the City’s practice to recommend removal of hardcover within the 0-75 ’ zone when <br />an application is under review; and <br />8. Other issues raised by the Planning Commission. <br />Staff Recommendations: <br />Staff recommends approval of the requested variances w ith the condition that 1,506 s.f. of plastic <br />hardcover on the property be removed prior to building permit approval. <br />If the Planning Commission concludes that the structural coverage should be reduced, the shed <br />(128 s.f.) may be potentially removed, reducing the structural coverage from 2,848 s.f. (16.3%) to <br />2,720(15.57%). <br />If the Planning Commission concludes that hardcover should be removed on the property, the <br />following may be potential removals: <br />a) In the 0- 73 ’ hardcover zone, the follow ing could be considered: <br />1) The concrete steps on the north side of the “grass area’’ could potentially be removed to <br />reduce the hardcover from 1,341 s.f. (24.86 %) to 1,292 s.f. (23.95%); and <br />2) In the future, if repair of the concrete patio and walkway (821 s.f.) become necessary, <br />they should be removed, further reducing hardcover to 471 s.f. (8.73%). <br />b) In the 75 ’-250 ’ hardcover zone, the following could be considered: <br />1 ) Removing a portion of the driveway (264 s.f. or 44’ x 6 ’) closest to the southern property <br />line, reducing hardcover from 6,442 s.f. (57.08%) to 6,178 s.f. 54.74%); and <br />2) If the shed (128 s. f.) and patio blocks surrounding the shed (116 s.f.) were removed m the <br />future, the hardcover would be further reduced to 5,934 s.f.
