• H •D <br />IH4-63 <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.___4 9 2 9 <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 14 (C); <br />SECTION 10.22, SUBDIVISION 1 (B); <br />SECTION 10.22, SUBDIVISION 2; <br />SECTION 10.56, SUBDIVISION 16 (C)(6); <br />AND SECTION 10.56, SUBDIVISION 16 (L)(2) <br />FILE NO. 03-2866 <br />WHEREAS, Judy and David Zoschke, ^husband jnd wife, (hereinafter "the <br />Lot 6 and the Northwesterly half, front and rear, of Lot 7, “Gust S. Johnson’s <br />Addition”, Hennepin County, Minnesota, (hereinafter “the property"); and <br />AMIEREAS, the applicants have applied to the City- for variances to Municipal <br />Zoning Code Section 10.03, Subdivision 14(C); Section 10.22. Subdivision 1 (B); Secaon 1022 <br />Subdivision 2; and Section 10.56, Subdivision 16 (C)(6) and Section 10.56, Subdivision 16 <br />(L)(2) to replace an existing 507.6 s.f. lakeside deck, enclosing 151 s.f as patio area, w* 2 848 <br />s.f. (16.3%) of structure where 2,620 s.f. (15%) is permitted; 6,442 s.f. (57.08%) of hardcover <br />where 2,821.5 s.f. (25%) is permitted in the 75’-250’ hardcover zone; and a 21 ’ encroachment <br />into the average lakeshore setback in the LR-IC zoning district; and <br />due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City- of Orono Zoning and Planning Codes, the Orono Plannine <br />Commission held a public hearing on February 19,2003, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1.
