% <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-330 (b) <br />HLE NO. 03-2960 <br />WHEREAS, Timothy J. Mahoney and Kelly A. Mahoney, husband and <br />wife, (hereinafter “the applicants”) are the owners of the property located at 2760 <br />Pheasant Road within the City of Orono (hereinafter the “City”) and legally described as <br />follows: <br />Those parts of Lot 2, Block 1, YALE SMILEY ADDITION, Hennepin County, <br />Minnesota and Lot 15, “PHEASANT LAWN”, Hennepin County, Minnesota <br />which lie southerly of the following described line: Beginning at the most <br />westerly comer of said Lot 2; thence on a bearing of South S3 degrees 21 minutes <br />48 seconds East a distance of 36.40 feet; thence South 70 degrees 09 minutes 30 <br />seconds East parallel with the southerly line of said Lot 2 a distance of 36.00 feet; <br />thence North 67 degrees 44 minutes 45 seconds East a distance of 21.55 feet to an <br />intersection with the northerly line of the southerly 3.92 feet of said Lot 2; thence <br />South 70 degrees 09 minutes 30 seconds East along said northerly line of <br />southerly 3.92 feet to the southeasterly line of said Lot 2 and said line there <br />ending. <br />(hereinafter the “property”); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for a variance to Orono Municipal Zoning Code Section 78-330 (b) to allow a new 7/12 <br />pitch roof with a covered entry to be setback 29’ from the front property line when 35 ’ is <br />normally allowed and 33 ’ currently exists. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1 .
