Building & Zoning Inspector, you were <br />notified that your newly constructed cecent sport court and your fenced garden are in <br />violation of City Code. You were directed a: diat ±ne to take the necessary steps in <br />order to bring your property into compliance by July II. 2003. <br />In early September 2003, you were again nodf ed by City Staff that your cement sport <br />court was in violation of City Code, as it was constructed without a permit and does not <br />meet the required 30* side yard setback. On Sentemrer 9,2003, you applied for an after- <br />the-fact setback variance to allow the spen ccurt to remain in its current location. You <br />were notified by Planning Director, Mike Gafron. ±at items were missing from your <br />application and you were given a deadline of Octo ’cer 1. 2003 for submittal. To date <br />those items have yet to be submined and ycur garden has not been brought into <br />compliance with City Codes, therefore your arplicanon has been removed from the <br />October 20* Planning Commission agenda. <br />At this time, concerning the cement spcncoun. you have the following options: <br />1. Remove the cement sport court in i*a entirety, cr <br />2. Submit the requested materials by November !. 2003 to proceed with the variance <br />hearing on November 17,2003. <br />Additionally, in reference to the garden, i: must *ce relocated on to your own property and <br />the fence may be no more than 6 ’ within 30* of the preperxy line. Finally, there may be no <br />fill or retaining wall located within 5’ of the property line. <br />Your garden and cement sport court, as constructed, do not meet City Ordinances. In <br />order to resolve this matter; you are required to bring your property into <br />compliance with City Codes by November 1, 2003. In two separate letters.
