Box 66 <br />Cfystal Bay, MN 55323-0066 <br />September 25,2003 <br />Judy & David Zoschke <br />2040 Shadywood Road <br />Wayzata, MN 55391 <br />Re: Status of Required Hardcover Removals <br />Dear Mr. & Mrs. Zoschke: <br />Building Inspector Bruce Vang has advised me that your construction project is nearly complete. <br />When we last talked, I indicated I would poll the members of the Planning Commission who <br />reviewed the variance request to see whether they agreed or disagreed with your position regarding <br />the specific hardcover elements that were to be removed. Having discussed this with most of the <br />Cornmissioners present during that review, and then having had Commissioner Mabusth review the <br />audio tape of the meeting, it appears there is no clear consensus of recollection as to what portions <br />were to be removed. <br />At this point, there are two apparent options for resolving this matter: <br />1. Remove the portions of patio as defined on the diagram attached to the resolution; or <br />2. Formally appeal the administrative conclusion reached by staff. <br />The foTOal appeal process is specified in Zoning Code Sections 78-96 through 78-99 (copy attached) <br />which includes a formal public hearing and review by the Planning Commission, followed by final <br />action by the City Council. The appropriate appeal application form is attached. The appeal fee is <br />SI00.00 as established by City ordinance. The information you need to provide includes the <br />completed application form, the fee, and a letter of request and supporting information clearly <br />describing your position. We will use the neighbor address list you provided with your original <br />application. <br />At this point you must either comply with the removals per the resolution, or immediately file the <br />appeal paperwork and fee. I would prefer that if you choose to appeal, you make that decision very <br />soon so that we can place this on the Planning Commission ’s October 20 agenda.
