A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-1279 <br />FILE NO. 03-2956 <br />WHEREAS, Hossnpat Construction, (hereinafter “the applicant") is the <br />owner of the property located at 849 Brown Road North, within the City of Orono <br />(hereinafter the “City") and legally described as follows: <br />The South 248 feet of that part of the Southeast Quarter of the Southwest Quarter of <br />Section 27, Towioship 118 North, Range 23 West of the 5*** principal Meridian, described <br />as follows: Beginning at a point on the East line of said Southeast Quarter of the <br />Southwest Quarter distant 354,75 feet North of the Southeast comer of said Southeast <br />Quarter of the Southwest Quarter: thence North along said East line a distance of 635.25 <br />feet; thence West parallel w ith the South line of said Southeast Quarter of the Southwest <br />Quarter a distance of990 feet; thence South parallel with said East line a distance of <br />635.25 feet; thence East to the point of beginning, which lies south and southw esterly of <br />the follow ing described line: Beginning at a point on the East line of said Southeast <br />Quarter of the Southwest Quarter distance 384.76 feet North of the Southeast comer of <br />said Southeast Quarter of the Southwest Quarter; thence west parallel with the South line <br />of said Southeast Quarter of the Southwest Quarter a distance of 1 78.00 feet; thence <br />Northwestc, ’.y deflecting right 54 degrees 25 minutes 38 seconds to the north line of the <br />above described property and said line there ending. <br />(hereinafter the “property”); and <br />WHEREAS, the applicant has made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a <br />new' residence encroaching past the average lakeshore setback on a property abutting <br />Dickey’s Lake. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1 .
