Location factors that make <br />these lots unique and add to the potential for possible enhanced public uses include: <br />> adjacency to the shoreline <br />adjacency to a 66' City road right-of-way that extends to the lake <br />adjacency to a City-owned 20' right-of-way that connects to the Dakota Rail future regional <br />trail corridor <br />location in the Navarre area with many non-lakeshore homes within walking distance <br />only 3 blocks to the Navarre Park <br />Other unique aspects of these parcels include: <br />three of the 4 properties across the road are underutilized in terms of residential use, with <br />building values of $2S,000 or less; the primary value of those lots has been in their proximity <br />to the lake, and without lakeshore rights, their market values may be significantly reduced; <br />the extent of such reduction is difficult to determine, but the land value might be reduced by <br />perhaps 1/3 according to the City Assessor. <br />a culvert under the Dakota rail line had long been causing a neighborhood drainage problem <br />for these lots, as it outletted in their back yards and did not have a specified channel to the <br />lake. This drainage situation was improved via a City project within the last year. <br />The fact that there may be a number of off-lake parties with “bathing and boating rights” over the <br />City parcels might tend to make some use options more complicated. Options for possible long-t <br />use that could be explored might include the following:erm <br />I. Do nothing, let the four lot owners across the road continue to put docks on City property <br />Deal with rental slip situations as a separate issue. <br />2. Require removal of the docks from the 4 City parcels. This has potential to result in a costly <br />legal battle since the property values will decrease significantly as soon as lake access is <br />denied. <br />3.Sell each parcel to its opposite off-lake landowner (Question for City Attorney: Can the City <br />selUhis property) owner deal with the consequences of the potential multiple <br />4. <br />5. <br />Lease the individual lots to the respective four owners for unlimited lakeshnw access. <br />Lease the individual lots to the respective four owners for limited lakeshore access, perttaps <br />limiting the number and ownership of boats stored on the site. <br />6.Lease the lots as a group to an association of the four, to have one joint use dock on the <br />property subject to an annual joint use dock license with limits on the number and ownership <br />of boats stored. Such a dock might be located to allow access for the possible off-lake <br />holders of “bathing and boating ” easement rights. <br />wrrarracflm
