I <br />CITY of ORONO <br />4. <br />5. <br />RESOLUTION OF THE CITY COUNCIL <br />NO. & 87 P <br />D.As a condition of the 1992 approvals, required hardcover improvements <br />have been removed and hardcover is currently at 4,991 s.f. or 36.1%. <br />C.Based on the curvature of the shoreline and the location of mature trees <br />in the adjacent street yards, the proposed 6 ’ expansion of a deck beyond <br />the average lakeshore setback line poses no visual impact on the adjacent <br />properties. <br />D.The proposed improvements will result in additional reductions in <br />hardcovc- within the 75-250’ setback area. <br />E. The lakeside deck would be consistent with adjacent lakeside decks on <br />residences also designed with walkouts to lakeshore. <br />F. 523.6 s.f. of new deck area shall be installed over 378 s.f. of patio and <br />former paved walk area approved in 1992. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conclitiotis, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of Uie above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Sections 10.22, Subdivisions 1 (B) and 2 to permit <br />the construction of a lakeside deck of approximately 523.6 s.f., subject to the following conditions; <br />Page 2 of 5 <br />I <br />i
