The applicants are requesting to replace an <br />existing deck and make slight alterations which increase it’s square footage by 33 square <br />feet. Also, the current deck and the proposed deck include 15 square feet in the 0-75’ <br />zone (south west comer of deck). <br />Lake Setback Variance <br />The applicants are proposing the keep the 15 square feet of deck that encroaches in the 0- <br />75’ zone. This results in a lake setback variance because the deck is setback 72’ from the <br />lake when 75* is required. <br />Hardship Statement <br />Applicant has provided a brief hardship statement in Exhibit D, and should be asked for <br />additional testimony regarding the application. <br />Hardship Analysis <br />tn considering applications for variance, the Plattnlng Commission shall consider the effect the <br />proposed variance upon the heabh, safety and weffare of the community, existing and anticipated <br />traffic conditions, light and air, danger of fire, risk to the puUlc safety, and die effect on values of <br />property In the surrounding area. The Planning Commission shaU consider recommending approval <br />for variances from the Uterat provisions of the Zoning Code hi hutances where their strict <br />enforcement would cause undue hardsh^ because of circnmttnnces unique to the Individual <br />property under consideration, and shall recommend approval onty when It is demonstrated that such <br />actions will be In keeping wUt the spirit and bilent of the Orono Zoning Code. <br />J
