4. <br />5. <br />6. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments by <br />the applicant and the public, and the effect of the proposed variance on the health, <br />safety and welfare of the community. <br />The City Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district; that granting the <br />variances would not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to nr/’serve a subsfant;<)i property right ofth; cpp’.icar.t; -r.i <br />would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council finds that granting a conditional use permit to allow limited <br />plumbing in the accessory structure will not be detrimental to the health, safety or <br />general w'elfare of the public, would not adversely affect light, air nor pose a fire <br />hazard or other danger to neighboring properties, nor will its use depreciate <br />surrounding property values and that the proposed level of use of the property will <br />be in keeping with the intent and objectives of the Zoning Code and Comprehensive <br />Plan of tlie City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants <br />a variance to Orono Municipal Zoning Code Section 10.28 Subdivision 5B to allow construction of <br />a 996 s.f detached garage/pool house/storage building, 23.1' from the side street lot line where a 50' <br />side street setback is required; and grants a variance to Section 10.28 Subd. 5(B) to allow the <br />construction of a 20' x 45' (900 s.f.) in-ground swimming pool 15' from the side street lot line where <br />a 50' side street setback is normally required; and grants a conditional use permit (CUP) per Section <br />10.20, Subd. 3Q for plumbing in an accessory building as propos .>d; but denies a variance to Section <br />10.03 Subd. 9(C)(2) allow the new building to be attached to the existing 848 s.f. detached garage; <br />subject to the following conditions: <br />1.The applicants shall establish and maintain year-round vegetative screening along the south <br />boundary of the property to reduce the visual impact of the pool and accesso^ building. <br />Page 3 of6 <br />i
