If you “trade” the square footage of <br />hardcover that is under to the square footage that is over you still get a net overage of 925 <br />s.f. These numbers include the 860 s.f. of hardcover proposed with the new building <br />(refer to Exhibit G and 1 for clarification). The Planning Commission should discuss <br />whether the applicant should be required to remove amounts of hardcover equal to what <br />is being proposed, 860 s.f, or if the applicant should remove the amount of hardcover <br />that would be necessary for the property to be in compliance, 925 s.f, (assuming trading <br />from the 75-250’ and 250-500 ’ zones is allowed). <br />Staff would make the follow ing recommendations in regards to the criteria for “undue <br />hardship” pertinent to this application: <br />1. <br />2. <br />4. <br />“The property in question cannot be pul to a reasonable use if used under <br />conditions allowed by the official controls." <br />The property could exist in Ihe numner it exists today if the variances were <br />denied. <br />“The plight of the landowner is due to circumstances unique to his property not <br />created bv the landowner." <br />In regards to the variance for the water meter, the circumstance is unique to the <br />property. Staff directed them to keep utilities within the property boundaries, and <br />due to desit^n con.straints. a separate water meter is the only option. <br />In regards to hardcover, the plight of the landowner is due to circumstances of <br />which were created by the landowner. The property is large enough in area to be <br />held to the hardcover requirements: however, improvements have been made to <br />the property causing an overage of hardcover. <br />3. “The variance, if granted, w ill not alter the essential character of the locality." <br />Should a variance to allow the separate water meter be approved, the essential <br />character of the locality will not change because the apartment would be non <br />rental and not occupied as separate living quarters. <br />Hardcover variances will alter the essential character of the neighborhood <br />because these are large houses on large lots. One s hardcover is limited by the <br />size of your lot. A 2.356 acre lot is adequate area to accommodate reasonable <br />amounts of hardcover. <br />"Economic considerations alone shall not constitute an undue hardship if <br />reasonable use for the property exists under the terms of the Zoning Chapter." <br />Hot applicable <br />\ * <br />• k <br />Jl
