c. <br />CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.______4 H 9 4 <br />A RESOLUTION GRANTING PRELIMINARY <br />APPROVAL FOR A TWO LOT SUBDIVISION <br />OF PROPERTY LOCATED AT <br />3320 WAERTOWTS ROAD <br />PID 32-118-23-41-0001 <br />FILE NO. 02-2839 <br />WHEREAS, Boyer Building Corporation, (hereinafter "the subdivider") on <br />September 30,2002, filed an application with the City of Orono (hereinafter "the City") requesting <br />subdivision of property located at 3320 Watertown Road within the City of Orono and legally <br />described as follows: <br />The Northeast Quarter of the Southeast Quarter of Section 32, Township 118 North, <br />Range 23, West of the S'** Principal Meridian, Also; The West 23 rods (379.5 feet) of <br />the East 43 rods (709.5 feet) of the North 33 rods (544.5 feet) of the Southeast <br />Quarter of the Southeast Quarter of Section 32, Township 118, Range 23; Also: I'hat <br />part of the Southeast Quarter of the Southeast Quarter of Section 32, Township 118, <br />Range 23, lying West of the East 43 rods (709.5 feet) and northerly of County Road <br />and Easterly of a line described as follows: Commencing at a point in the North line <br />of the Southeast Quarter of the Southeast Quarter distant 14 feet East from the <br />Northeast comer of the West 30 rods (495 feet), 1032 feet; thence Southw esterly to a <br />point in the northerly line of County Road No. 45 distant 10.9 feet southeasterly <br />along said Road line from its intersection with the East line of the West 30 rods (495 <br />feet) of the Southeast Quarter of the Southeast Quarter; Also That part of <br />Government Lot 1, lying South of Railroad Right of Way in Section 32, Township <br />118, Range 23, Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Subdivision Codes, the Orono Planning <br />Commission held a public hearing on October 21,2002, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />WHEREAS, at their regular meeting held on November 25,2002 the Orono City <br />Council considered the subdivision application of the subdivider noting the following findings of <br />fact; <br />Page 1 of 6 % <br />I <br />} t <br />! ;
