5. <br />6. <br />and setback encroachments are necessary to allow the house to be located <br />where it will allow for minimizing the driveway hardcover on the street side <br />of the house. <br />Existing hardcover in the 0-75' zone includes retaining walls, stairways and <br />landings which are necessary to maintain the steep slopes and provide access <br />to the lake. The applicant proposes to keep 683 s.f. of wails, stairways and <br />landings resulting in a 0-75' hardcover of 5.7%. The applicant has agreed to <br />remove an existing 8'xl2' shed in the 0-75' zone. <br />Existing hardcover in the 75-250' zone is 6,180 s.f. or 37.1 %. Final proposed <br />hardcover in the 75-250' zone is 4,690 s.f. or 28.2%. The hardships supporting <br />the 75-250' zone hardcover variance include the steep slopes which limit the <br />house location and require walls and walkways; the topography near the road <br />and the elevation and configuration of the existing garage which will remain, <br />and the need to provide safe access to the property while retaining adequate <br />parking on-site since the narrow Highwood Road is inadequate for parking. <br />The average lakcshore setback encroachment of approximately 12' for the <br />proposed house will have no impact on views of the lake enjoyed by the <br />adjacent property owners. The proposed reconfigured deck is low enough to <br />similarly have no view impacts. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments by <br />the applicant and the public, and the effect of the proposed variances on the health, <br />safety and welfare of the community. <br />The City Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district; that granting the <br />variances would not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />Page 3 of 7
