<br />The property at 3980 Dahl Road, Orono, Minnesota, has had an accessory structure located
<br />at the shoreline of Lake Minnetonka, most probably since the 1940’s and, perhaps, earlier than that.
<br />The accessory structure was originally constructed as a “boathouse” and was existing on January 1,
<br />1975. Accordingly, it is “grand fathered” as a non-conforming structure under the provisions of the
<br />Orono City Zoning Code. The current owner of the property, Thomas P. McGlynn, purchased the
<br />property on July 22, 1993, at which time the accessory structure was no longer being used as a
<br />boathouse but was being used for storage and as a playhouse.
<br />In 2002, Mr. McGlynn and his wife, Toni, determined that certain repairs needed to be made
<br />to the structure. They accordingly hired Plekkenpol Builders, Inc., of Bloomington, Minnesota,
<br />Minnesota Residential Construction License No. 1797, to make the repairs to the accessory structure.
<br />In August 2002, prior to commencing work on the structure, Plekkenpol Builders, Inc., contacted
<br />Lyle Oman, Orono City Building Inspector, to discuss making the repairs. On September 10,2002,
<br />a meeting was held at the McGlynn residence, at which time Lyle Oman confirmed that the structure
<br />was not in such disrepair that it would condemned, and accordingly, repairs could be made on the
<br />structure, subject to the issuance of a Building Permit.
<br />During the winter. Plans were drawn for the repairs to the accessory structure which were
<br />presented to the City on March 18,2003. On March 31,2003, a Permit was issued for the repairs
<br />to the structure. Certain of the proposed repairs had been crossed off on the “Redline Plan ” which
<br />repairs were, accordingly, eliminated from the contract between Mr. McGlynn and his builder.
<br />Revised Plans were submitted to the City Building Inspector on April 10, 2003, which
<br />included replacing the windows and installing a new header above the window's. Lyle Oman, on
<br />April 10*, approved the revised Plans.
<br />Work was commenced on April 18, 2003. As part of the repair work, the structure was
<br />moved off its foundation in order to install 3/4 inch plywood sheathing on its bottom, pursuant to
<br />the approved Building Plans. The repairs, so far as possible, used existing materials but did, as
<br />allowed by the Building Plans, include the installation of certain new material. The new material
<br />includes the 3/4 inch plywood sheathing on the bottom of the structure, new insulation between that
<br />sheathing and the existing finished floor, new interior knotty pine on the existing plywood and
<br />existing wooden studs, new knotty pine ceiling over the existing plywood and existing joists, new
<br />exterior cedar-lap siding covering over the existing plywood sheathing and existing studs, and a new
<br />single-ply EPDM roof membrane over new ice and water shield on the new 3/4 inch plywood
<br />sheathing roof over the existing joists, as well as in«t.ilIation of new windows and doors.
