Therefore, if council <br />concludes that a variance is necessary, the application could be referred back to the Planning <br />Commission for a recommendation. <br />COUNCIL ACTION REQUESTED <br />Council is requested to provide direction as to whether an after-the-fact variance is necessary or <br />whether the proposed/completed work meets any of the possible criteria for exemption. If a variance <br />is required. Council must then determine whether a hardship exists that supports granting of the <br />variance. <br />Options for action: <br />1.Determine that a varianee is required and refer the application back to Planning Commission <br />for fiirther review of whether a hardship exists to support granting of a variance. <br />2. Determine that a variance is required and reach a conclusion without Planning Commission <br />recommendation as to whether a hardship exists to support granting of the variance. <br />3.Determine that the structure meets criteria for exemption and does not need a variance to be <br />placed back in its former location. <br />4.Other
