Lot area of 20,300 sf (0.476 ac) whcie 43,560 s.f (1.0 ac) is required. <br />2. Hardcover in the 0-75' zone: 274 sf (2.47%) where no hardcover is permitted. <br />3. Hardcover in the 75-250’ zone: 2,790 s.f. (30.36%) where only 25% is normally <br />permitted (see calculation discussion below). <br />4. Grading and niling within 75' of the OHWL of Lake Minnetonka where no grading or <br />filling is normally pennitted. <br />5. Placing fill in a bluff impact zone where no fill is normally permitted. <br />Regarding the 75-250’ hardcover. Council indicated they agreed that the pie-shaped lot <br />configuration is a hardship. If the lot was completely rectangular, no hardship would be present, <br />which is what the Council concluded on the Toth site to the immediate north. To quantify the <br />extent of your hardship, your lot shape is redefined ('regularized') as a rectangle by pivoting <br />the angled south lot line at its center point to become parallel with your north line. The <br />triangular area east of the center pivot (which is at approximately the 75' setback line) is then <br />credited to the west portion of your lot, as depicted in the exhibit provided by your architects <br />early in the review process, and as depicted in my confirmative sketch attached. <br />The result is that your 75-250’ zone would 'expand' from 9,190 s.f. to 11,160 s.f and your <br />25% 75-250* hardcover allotment would grow from 2,298 s.f to 2,790 s.f This is functionally <br />a 492 s.f variance and your hardcover would be at 30.36% of the actual 75-250' zone. <br />A resolution reflecting the above will be drafted and placed on the Council's July 14 agenda <br />for final action.
