the Zoning Chapter. <br />The proposed use will not conflict with other provisions of the Zoning Chapter. <br />Additional evaluation criteria for conditional use applications in a shoreland district are as <br />follows: <br />1. The prevention of soil erosion or the possible pollution ofpublic waters, both during <br />and after construction; <br />Recommendations made by the City Engineer will be conditions of approval of this <br />application, ensuring that the proper measures are taken during construction. <br />2. The visibility ofstructures and other facilities as viewedfrom public waters is <br />limited: <br />The pathway is proposed to be reconstructed for safe use. As it exists today, there will <br />be no significant change to the landscape as a result of its reconstruction. <br />3. The site is adequate for water supply and on-site sewage treatment; and <br />The site is hooked up to City sewer so on-site treatment is not an issue. <br />•/. The types, uses and numbers of watercraft that the project will generate are <br />compatible in relation to the suitability of public waters to safely accommodate these <br />watercraft. <br />The proposal does not generate watercraft for the property. <br />Horses <br />Animals <br />Horses are a permitted accessory use in the RR-IB zoning district. The number of horses <br />permitted on the property is broken down as follows: <br />1 otal lot area: <br />Less wetlands: <br />Less 1 acre for house (Section 10.20, Subd. 3m) <br />25.4 acres <br />-16.04 acres <br />-1.0 acres <br />8.36 acres <br />Two acres of pasture are required for the first horse and I acre for each additional horse. <br />Therefore, up to 7 horses would be pemiitted on the property, assuming all 8.36 acres are <br />available for pasture. <br />The applicant does not intend to have horses permanently on the property. From time to time, <br />there may be up to 4 horses on the property, all of which are stabled elsewhere. The applicant has <br />suggested that a temporary' structure may be necessary for the horses, depending on weather <br />conditions. Structures, both temporary and permanent, are required to be located ISO' from the <br />OHWL of French Lake. If the horses are permitted to be located on the island, there is an area <br />within the center of the property which is outside the 1 SO' setback, permitting a temporary' <br />structure without variance approval. <br />Agricultural Use within 150' of the OHWL <br />Agricultural uses, including grazing, are permitted in the Shoreland Overlay District. However, <br />this use is not permitted within the shore setback zone.
