ClTYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ^^ 2 0___ <br />11. <br />12. <br />13. <br />14. <br />B.Orono will provide municipal sewer to lakeshore areas and nondakeshore <br />areas within the MUSA when it is determined that municipal sewer is <br />preferable to long-term use of on-site sewage treatment areas. <br />C.All sewer-serviced properties must be connected. Consistent with the <br />regulations of the Minnesota Health Department and the MCES, every <br />building intended for human habitation, occupancy or use shall be <br />provided with suitable sanitary facilities and shall be connected to the <br />municipal sewer system whenever a sewer lateral serves the property or <br />is within a reasonable distance of the property. <br />Municipal Code Section 12.30 regulates individual sewage treatment systems for <br />the City of Orono. This section requires that building permit applications for <br />new residences require Code Systems. The existing system is not a Code <br />System because it is located within 75' of the OHWL of Lake Minnetonka. <br />It is the position of the City of Orono that a new residence should connect to <br />municipal sewer service following extension of the sewer line from Baldur Park <br />Road. The existing house was required to connect to municipal sewer following <br />the 1965 LS 1 project and did not. <br />The property is located within the MUSA and in the Shoreland Overlay District. <br />In the Comprehensive Sewer Policy Plan (CMP Part 4 (C)) a principal goal of <br />Orono's plaiming program is the protection of natural resources and <br />environmental amenities, particularly the water quality of Lake Minnetonka. The <br />major pollutants affecting Lake Mitmetonka are contained in sewage effluent and <br />stormwater runoff. Orono's sewage treatment policies are directed at minim.2ing <br />or eliminating pollutant sources. <br />The Council finds that connection to municipal sewer is the only viable long <br />term solution to protecting the water quality of Lake Minnetonka. A private <br />sewage treatment system, on the point of the Baldur Park peninsula would have <br />lakeshore on three sides of the system. <br />Page 4 of 9 <br />'M <br />dm 1
