Gaffron <br />Title: Pianning Director <br />Agenda Section: <br />Zoning <br />Item Description: #02-2843 Professional Properties of Orono, 274S-276S Kelley Parkway - <br />Rezoning - Ordinance Adoption <br />List of Exhibits <br />A - Ordinance for Adoption <br />On November 12,2002 Council adopted Resolution No. 4890 granting General Development Plan <br />Approval for the Professional Properties of Orono dental office. Condition 2 of Resolution No. 4890 <br />stated: <br />‘2.Upon the final approval and execution of this resolution and the Planned Unit <br />Development No. 3 Agreement, the City Council shall formally approve an ordinance <br />amending the official zoning map of the City to rezone the Property and the Adjacent <br />Parcel from RR-IB Single Family Rural Residential District to B-6 Midway <br />Commercial District Planned Unit Development (B-6 PUD), and amending the Orono <br />Zoning Code by adding language c«:tablishing Planned Unit Development No. 3 <br />(PUD-3) to include the property and the Adjacent Parcel.” <br />As of this writing the applicants are preparing to execute the PUD No. 3 Agreement and are expected <br />to be providing evidence of ownership of the adjacent parcel. <br />Staff Recommendation <br />Staff recommends adoption of the attached “Ordinance Amending the Municipal Code of Orono and <br />Amending the Official Zoning Map by Rezoning Properties at 2745 and 2765 Kelley Parkway from <br />RR-IB Single Family Rural Residential District to B-6 Highway Commercial District and Adding <br />Section 10.53 Subdivision 10 Regarding Planned Unit Development No. 3", subject to the ordinance <br />not being published until the PUD No. 3 Agreement has been executed and evidence of ownership <br />of the adjacent parcel has been received. <br />COUNCIL ACTION REQUESTED <br />Adopt or amend the attached Ordinance. <br />i <br />i <br />i
