A RESOLUTION GRANTING CERTAIN VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 (B); AND <br />SECTION 10.56, SUBDIVISION 16 (CK6) <br />FILE NO. 03-2891 <br />WHEREAS, Eric and Karen Paulson, husband and wife, (hereinafter "the <br />applicants") are the owners of the property located at 2605 Maple Ridge Lane, within the City of <br />Orono (hereinafter "the City") and legally described as follows: <br />Lot 7 and that part of Lot 8, “Shore Hills", described as follows: Beginning at the <br />point of intersection of the dividing line between Lots 7 and 8 in said Shore Hills <br />with the shore of Lake Minnetonka, thence Southerly along said dividing line to the <br />Northerly line of Mapleridge Lane in said Plat; thence Northeasterly deflecting to the <br />left 150 degrees 25 minutes from last described course a distance of 109.8 feet; <br />thence Northerly deflecting to the left 29 degrees 00 minutes from the last described <br />course to the . *re of Lake Minnetonka; thence Northwesterly along said shore line <br />to the point of beginning, Hennepin County, Minnesota (hereinafter "the property"); <br />and <br />WHEREAS, the applicants have applied to the City for variances from Municipal Zoning <br />Code Section 10.22, Subdivision 1(B); and Section 10.56, Subdivision 16 (CX6) to permit <br />construction of an in-ground pool that encroaches 32' into the average lakeshore setback, and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on May 19,2003, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />I.
