5. <br />6. <br />The Planning Commission made the following findings of fact: <br />A. The lot area and lot width meet the zoning district requirements; <br />B. The proposed deck increases structure on the property but does not exceed the <br />maximum n^rmitted; <br />C. The lot has two 0-75’ hardcover zones; <br />D. No additional hardcover is proposed in the 0-75’ hardcover zones; <br />E. The proposed deck minimally increases hardcover in the 75’-250’ hardcover <br />zone by 86 s.f. Hardcover within this hardcover zone should not increase <br />from what exists with this application; and <br />F. The 40’ street right of way on the property is not included in the lot area or <br />hardcover calculations. There is a small portion of the house and related <br />hardcover existing within the right of way. <br />The City Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district; that granting the <br />variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard <br />or other danger to neighboring property; would not merely serve as a convenience to <br />the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the applicants; and would Ire in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />The City Council has considered this application, including the fmdings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicants and the effect of the proposed variances on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants variances from <br />Municipal Zoning Code Section 10.22, Subdivision 2; and Section 10.56, Subdivision 16 (L)(2) to <br />permit construction of o deck and stairs 5’ in height onto the existing home, and to allow 5,510 s.f. <br />(40.9%) hardcover within the 75’ to 250’ setback zone where only 3,366 s.f.
