NOW, THEREFORE, in consideration of the premises, and of the actual promises and
<br />conditions hereinafter contained, it is hereby agreed as follows:
<br />A. General Terms and Conditions

<br />Property Description. This Planned Unit Development No. 4 Agreement for Dahlstrom
<br />Development Corporation LLC applies to the following described property located in
<br />Hennepin County, Minnesota:
<br />Outlot B, Willow Properties Addition, Hennepin County, Minnesota,
<br />except Parcel 201 and 201a Minnesota Department ofTransportation Right
<br />of Way Plat No. 27-57
<br />(hereinafter the "Property").
<br />Property Deseriotio ns after Platting . The property descriptions after platting and dedication
<br />of right-of-ways for Kelley Parkway, Willow Drive and Highway 12 shall be as follows:
<br />Lots 1 through 46, Block 1; Lots 1 through 10, Block 2; and Outlots A, B,
<br />C, D, E, F, G, H, 1, J and K, STONEBAY, Hennepin County, Minnesota.
<br />Zoning. The portion of the Property located north of Kelley Parkway, comprising Lots 1
<br />through 46, Block 1, Lots 1 through 10, Block 2, and Outlots E, F, G, H, I, J and K is
<br />zoned Residential Planned Unit Development (RPUD) District. The portion of the Property
<br />located south of Kelley Parkway, including Kelley Parieway and Outlots A, B, C and D is
<br />zoned RR-IB (PUD) Single Family Rural Residential District, and shall remain zoned RR-
<br />IB (PUD) until such time that the City approves a rezoning.
<br />4. Permitted Uses. Within the Property the permitted uses are as follows:
<br />Within Lot 46, Block 1 and Lot 10, Block 2 the permitted uses shall be common
<br />open spaces, private streets and driveways, utility systems, sidewalks, retaining walls
<br />and other landscaping features ancillary to the residential development, including
<br />approved signage and lighting. No accessory buildings except as indicated on the
<br />approved plans shall be allowed within Lot 46, Block 1 or Lot 10, Block 2.
<br />b) Within Lots 1 through 45, Block 1 , and Lots 1 through 9, Block 2, the permitted uses
<br />shall be attached residential dwelling units.
