Lw..___
REQUEST FOR COUNCIL ACTION MAY 1 2 2003
CONSENT AGENDA ITEM
CITY Oh OHONO
Date: May 7,2003
Item No,. 3
Department Approval: Ad^nistrator Approval:
Name: Michael P.
Title: Planning Director f
Agenda Section:
2U>ning
Item Description: i^2S06 Edward Hamm, 46S-48S Orono Orchard Road - Resolutions -
Reconfirm Past Action
List of Exhibits
A - Staff - City Attorney Correspondence
A • Confirmative Resolution for Adoption (Sewer Connection Approval)
B • Confirmative Resolution for Adoption (Guest House CUP)
C • Resolution No. 4271 Adopted 4-12-99
D - Resolution No. 4335 Adopted 8-23-99
In 1999 Edward Hamm was granted approval to connect his property to municipal sewer, and was
granted a CUP for a guest house use. The conditions of approval of those resolutions were met.
However, due to Mr. Hamm being out of state for months at a time, the resolutions were not
immediately signed by Mr. Hamm. They were eventually sent to Florida for signature. The first
set never was returned, and a second set was eventually returned signed but without notarization, and
hence could not be filed.
To resolve this, at the advice of the City Attorney, we are presenting Council with confirmative
resolutions which have recently been signed by Mr. Hamm and notarized. These are identical to the
original resolutions but each contain an additional “Whereas” paragraph stating that the new
resolution is to confirm the prior action.
COUNCIL ACTION REQUESTED
Motion to adopt resolutions confirming Resolutions No. 4271 and 4335.
----- -------
