AtuchmentB <br />STORMWATERFACILmr MAINIENANOE <br />These terras apply to the stormwater facStties constnKted pursuant to Minnehaha <br />Geek Watershed Distrkt permit api^ication number 02-058. <br />WHEREAS, Applicant has applied for a periiut from the MCWD punuant to <br />MCWD Rule N, Stormwater Mstnagement; and <br />WHEREAS, the property that is the subjea of this agreement is legally described in <br />the Declaration into which this Attachment is incotporated and the wet retention pond and <br />infiktation basin on the property to wkich these maintenance requirements apply are described in <br />Anachment A - Erosbn GontroC Grading and Drainage Plan dated 10/23/02; <br />WHEREAS, MCWD Rule N provides that a maintenarKe agreement shall be <br />submined for stormwater treatment ponds, outlet structures for such poods, culverts, outfall <br />structures and all other stormwater facilities, and that the maint^nanf^ agreement shaD specify <br />methods, schedule and responsible patties for maintenance and must mchide at a minimum, the <br />elemenu contained in the Distrkt’s h^tenance Agreement Form. <br />NOW, THEREFORE: <br />1. Applicant shaU impea the stormwater retention and treatment basin(s) at a <br />minimum of once a year to determine if the basin’s retention and treatment characteristics are <br />adequate. A storage treatment basin will be considered inadequate if sediment has decreased the wet <br />storage volume by Vi of its original design volume. Based on this inspecrion, if the stormwater <br />basin(s) is identifi^ for sediment cleanout, Applicant shall restore the ba$in($) to its original des^ <br />contours within one ]ear of the iiupection date. <br />2. Applicant shall inspea the grit chambers, tump catch basiiu, sump <br />manholes, outlet structures, culverts, outfall structures or other stormwater facilities for the projea in <br />the spring and fall of each }car. Applicant shall remove all sediment and debris during the <br />inspections such that the stormwater facthties operate as designed and permitted. <br />3. Violation of the inspection and/or maintenarKe provisions of this <br />Agreement is a violation of the MCWD permit for the projea for which the MCWD may take action <br />against the Applicant.
