8. Other issues raised by the Planning Commission. <br />Staff Recommendation: <br />With the existing foundation be removed and a new one constructed to accommodate the one <br />story addition above it, it is an opportumty for the city to have the residence conform to the <br />required side yard setback of 10 ’. Staff has reviewed the application and the hardship provided <br />and does not see a substantial hardship which would justify the side yard setback variance. <br />If the Planning Commission feels there are substantial hardships for the replacement construction <br />of the foundation to be 5’ rather than 10 ’ from the property line, then a recommendation of <br />approval would be appropriate. <br />•♦Due to the plan changes being submitted on Friday morning, on Monday staff will have <br />detailed hardcover and structure calculations that will show the difference in a 5’ side yard <br />setback versus a 10 ’ side yard setback. <br />#03-2881 Curtis/Kathleen Midihun <br />2941 Casco Point Road <br />4/18/2003 <br />Page 6 of 6
