Todd Zlesmer - 3440 Bayside Road <br />July 25, 1988 <br />Page 2 of 3 <br />Baaed on the above information, the City would allow a new house to be <br />connected to the existing system only under the following conditional <br />1. Prior to issuance of a building permit for the new house, owner <br />must provide a full site evaluation and design for a new conforming <br />septic system, both primary and alternate drainfield sites, in order <br />to confirm the suitability of the lot for permanent usage of septic <br />systems should sewers never become a reality. <br />2. The interim period during which the existing system could be used <br />is defined as followst <br />a) Maximum of 18 months from date of occupancy, renewable after <br />that on a 6 month periodical basis only if a Council decision to <br />install municipal sewers appears to be shortly forthcoming. <br />b) Should the existing system fail prior to a decision on sewer <br />installation, the system must be replaced with a totally <br />conforming system. <br />c) Likewise, if a decision to not make sewer available to the <br />property is forthcoming, the system must be replaced with a fully <br />conforming system within 6 months of the Council decision, <br />regardless whether the existing system is functioning adequately. <br />d) If sewer becomes available, the property must be connected to <br />it as soon as it becomes available. <br />e) At any time during the interim period, if the house is sold <br />the system must be replaced with a totally conforming system. <br />This approval Is not transferable to a new owner. <br />3. The City is in no way certifying that the existing system is <br />capable of functioning acceptably during the interim period. The <br />property oimer bears the responsibility for maintaining the system so <br />it does not become a health or safety hazard, nor a public nuisance. <br />A contractual agreement would have to be signed by you, agreeing to <br />the above conditions before a building permit would be issued. This would <br />be filed in the chain of title of the property.
