,WAr CITYNO.73 OF3 ORONo6 <br /> 10 (4 RESOLUTION OF THE CITY COUNCIL <br /> 1. <br /> "lkESHOV" <br /> A RESOLUTION <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 78-1279, 78-1680, & 78-1700 <br /> FILE NO. LA22-000055 <br /> WHEREAS, on October 19, 2022, Travis and Sara Wildenberg (hereinafter the <br /> "Applicants"), applied for variances from the City Code for the property addressed 3838 Cherry <br /> Avenue and legally described as: <br /> Lots 8 and 9, Block 3, Crystal Bay View, Hennepin County, Minnesota <br /> (hereinafter the"Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variances from Orono Municipal Zoning Code Section 78-1279 to allow construction of a second <br /> story addition 20 feet from the OHWL where a 75-foot setback is required and lakeward of the <br /> average lakeshore setback line; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variances from Orono Municipal Zoning Code Sections 78-1680 and 78-1700 to permit 32.9% <br /> hardcover where 33.9%currently exists and 25% is permitted to construct additions to the existing <br /> home and change the hardcover; and <br /> WHEREAS, on November 21,2022, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the opportunity <br /> to speak thereon; and <br /> WHEREAS, on November 21, 2022, the Planning Commission reviewed the <br /> application and provided direction to the Applicants for revisions; the Planning Commission <br /> recommended denial of the variances as applied; and <br /> WHEREAS, prior to City Council review, the Applicants provided amended plans <br /> reflecting the proposed second story 32 feet from the OHWL and a proposed hardcover reduction <br /> resulting in 7,380 square feet (32.6%) total hardcover; and <br /> WHEREAS, on January 9, 2023, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff and directed preparation of findings <br /> for approval of the variances reflected on the amended plans. <br /> 1 <br />
