The proposal meets the 10 ’ side yard setbacks and is less than the 1,500 s.f. lot coverage <br />by structure permitted for the lot; <br />9. lliere is a culvert draining under the lot from a wetland to the south and into Lake <br />Minnetonka. The City will not permit a home to be constructed over an existing culvert; <br />10. Other issues raised by the Planning Commission. <br />Staff Recommendations: <br />Staff recommends approval of the requested variances for new construction on the lot, with the* <br />following conditions: <br />1 . The rear setback should be reduced from the proposed 10 ’ to 5’ (or the length of the <br />home should be reduced by S’) in order to provide adequate driveway depth from Ciy stal <br />Bay Road, maintaining the existing structure’s setback from the OHWL and <br />encroachment into the average lakeshore setback; <br />2. A building of no more than 30’ and no more than 2 '/i stories in height will be permitted <br />to be constructed on the lot; <br />3. The existing culvert must be located prior to discussions with City staff regarding <br />relocation. Prior to obtaining a building permit, a survey showing the proposed relocation <br />of the culvert will be required. A drainage and utility easement of 10 ’ in width will be <br />required over the relocated culvert as well. The costs of these improvements will be the <br />financial responsibility of the property owner; <br />4. Existing and proposed grading and drainage ways should be shown on plans submitted <br />for a building permit; <br />5.
