Initial Draft 12>9*02 <br />Revised Draft I-23-03 <br />Revised Draft 4-l6^)3 <br />Revised Draft 4>21/2543 (Revisions since I >23-03 In Italics^ <br />NOT FINAL - SUBJECT TO COMPLETION AND REVISION <br />b <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINESOTA <br />PLANNED UNIT DEVELOPMENT NO. 4 AGREEMENT <br />“2550" WAYZATA BOULEVARD <br />DEVELOPER: DAHLSTROM DEVELOPMENT CORPORATION LLC <br />NAME OF DEVELOPMENT: STONER A Y <br />THIS AGREEMENT, made and entered into this___day of 200_, by <br />and between the City of Orono, a municipal corporation organized and existing under the laws of <br />the State of Minnesota (hereinafter called “City”), and Dahlstrom Development Corporation LLC, <br />a Minnesota Corporation, its heirs, successors and assigns (hereinafter called “Developer ”). <br />WITNESSETH: <br />WHEREAS, the Developer has made application to the City Council for approval of a <br />Planned Unit Development (PUD) rezoning and formal plot application for property located at <br />“2550" Wayzata Boulevard, such development to include the following elements: <br />1.Rezoning of the portion of the Property north of Kelley Parkway from RR-1 B Single Family <br />Rural Residential District to RPUD Residential Planned Unit Development District for <br />construction of 162 residential multi-family dwelling units on a portion of the site comprising <br />approximately 41 acres, such development to be known as “STONEBAY”. <br />2.Creation of two commercial outlets on -the remaining 10 actes south of Kellev Parkway <br />to be rezoned and developed at a later date. <br />3.As part of the residential development, construction of Kelley Parkway as a public street, as <br />well as construction of municipal sewer, water, and storm sewer systems to serve the <br />proposed development; and <br />WHEREAS, on January 27. 2003 the City Council granted General Development Plan <br />Approval for the proposed development subject to conditions per Resolution No. 4915. on the <br />condition that the Developer enter into this agreement to pro\ ide for conformance with the City’s <br />Planned Unit Development (PUD) ordinances, and to provide for the installation g/'and establish <br />responsibilities for maintenance of improvements associated with the development. <br />Page 1 of 18 <br />Developer Initial, <br />City Clerk Initial
