r <br />Pertinent Code Sections: <br />1. Section 10.24, Subd. 5 (B): Minimum Requirements: The following minimum requirements for <br />the LR-IB District shall be observed: lot area 1 acre; lot width 140 feet; rear yard 30 feet; side yard <br />10 feet. (Request: To allow a lot area of 0.19 acres (8,172 s.f.) where 43,560 s.f. (1 acre) is <br />required; lot width of 50 ’ at the 75’ setback from the OHWL and at the OHWL where 140’ is <br />required; rear yard (street) setback of 19.2’ where 30* is required; and side yard setback of 7.6 ’ <br />w here 10’ is required). <br />2. Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (L)(l) & (2): Hardcover within 75’: Within <br />75’ of the shoreline there shall be no excavating, filling, hardcover, temporary or permanent <br />structures. (Request: To allow 480 s.f. (12.6%) hardcover within the 0 to 75’ lakeshore setback <br />zone where none is permitted). <br />3. Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (L)(2): Hardcover within 75’ to 250’: <br />Between 75 feet and 250 feet of the OHWL there shall be no greater than 25% hardcover. (Request: <br />To permit 2,05 1 s.f. (46.8%) hardcover within the 75’ to 250 ’ lakeshore setback zone where 1,095 <br />s.f. (25%) is permitted). <br />4. Section 10.03, Subd. 14(C): Lot Coverage By Structure: For all lots of 0-1.99 acres in total area, <br />the total combined footprint areas of all principal and accessory structures shall not exceed 15?^ of <br />the lot area. EXCEPTION: Regardless of lot area, every developed lot shall be allowed at least <br />1,500 s.f of lot coverage by a principal residence and garage structures. (Request: To permit 1,504 <br />s.f of lot coverage by structure where 1,500 s.f is permitted). <br />5. Section 10.56, Subd. 3 (2 &3) and Section 10.56, Subd. 16 (C)(2 &3): Top of Bluff Setback & <br />Bluff Impact Zone: Structures must be set back 30' from the top of the bluff. The bluff impact <br />zone is defined as the bluff and land located within 20 ’ of the top of a bluff Structures and <br />accessory facilities, except stairways, landings, and lock boxes, must not be placed within bluff <br />impact zones. (Request: To permit a structure 15’ from the top of the bluff where 30’ is required; <br />and an encroachment of 6 ’ +/- into the bluff impact zone where none is permitted). <br />6. Section 10.56, Subd. 16 (J)(5)(h): Filling in bluff impact zones Fill or excavated material must <br />not be placed in bluff impact zones. (Request: placing fill in a bluff impact zone w here no fill is <br />permitted). <br />Discussion: <br />Lot Area & Lot Width <br />The existing area of the lot is 0.19 acres (8,172 s.f) where 43,560 s.f (1 acre) is required for the zoning <br />district. The existing lot width is 50 ’ at the 75’. setback from the OHWL and at the OHWL where 140’ <br />is required for the district. Neither the area of the lot nor the width is proposed to change w ith this <br />application.
