Pertinent Code Sections: <br />1.Section 10.22, Subd. 1(B) and Section 10.56, Subd. 16 (C): Structure within 75’ of <br />lakeshore: To permit a second story deck to be located 27.5’ from the OHVVL of Lake <br />Mirmetonka where 75’ is required. <br />2.Section 10.22, Subd. 1 (B) and Section 10.56, Subd. 16(C)(6): To permit encroachment into <br />the average lakeshore setback. The total encroachment is approximately 5 ’. <br />3.Section 10.03, Subd. l‘*(C): Lot coverage: Regardless of lot area, every developed lot shall <br />be allowed at least 1,500 square feet of lot coverage by principal residence and garage <br />structures. To permit a variance to allow lot coverage to be 1,650 s.f. where 1,500 s.f. was <br />previously approved. <br />4.Section 10.22, Subd. 2 and Section 10.56, Subd. 16(L)(1): Hardcover in 75-250 ’ setback: <br />To permit 2,115 s.f. (26.4%) of hardcover in the 75-250 ’ setback zone where 2,079 s.f. <br />(26"/o) was previously approved. <br />Discussion: <br />The subject property was purchased by the applicant in 2000. The plan was to demolish the <br />existing residence and cor^nuct a new residence on the property. Due to the size of the lot and <br />all of it being located within 75* of the OHWL of Lake Minnetonka variances were required to <br />redevelop the subject property. <br />The applicant submitted a variance application September, 2000. After discussions with staff <br />and some rer’.esigning the application was hea.rd at the November 20, 2000 Planning Commission <br />meeting. The Planning Commission recommended approval of the proposed project with <br />hardcover in the 0-75 setback zone to be 2,079 s.f. (26%) and lot coverage by structure not to <br />exceed 1500 s.f. both of which all lie within 75’ of OHWL of Lake Minnetonka. The <br />recon.recnudtion was based on the property was currently developed as a single family residence <br />with 2,328 s.f. of existing hardcover and over 1,500 s.f. of structure. The hardcover and structure <br />Oil tilt lot would decrease w ith redevelopment of the property. <br />The r.p;,!ica ion moved forward to the City Council and was approved at their December 11 <br />20'/0 meeting. The council approved the application and resolution which stated 3 original ’ <br />copic- a rev iseo survey showing the budding plans and all proposed hardcover be submitted <br />Also, the site plan'surv’cy shall be in substantial conformance with the plan attached to the <br />resolution. <br />The surv eys and building plans were submitted for review by the building depamnent. The <br />survev nad been rev.sed and was in substantial conformance with the hardcover and structure <br />approvals granted by the City Council. However, the building plans submitted showed a <br />different ground level deck, a screen porch, and a second level deck.
