i <br />neighborhood, 372 Westlake Street, met all of the setl?ack requirements for the zoning district <br />without requiring a setback variance. <br />PLANNING COMMISSION RECOMMENDATION; <br />Planning Commission recommended by a 6 to 1 vote to: <br />Approve the lot width and lot area variances as presented and to alter the side yard setbacks from <br />those proposed to not less than 20 feet on each side, permitting up to a 4 foot encroachment into <br />either 20’ side yard for roof overhang but no other structural elements and requiring the removal <br />of the e.xisting shed in the 0-75’ hardcover zone, which applicant at his option may replace with a <br />lock box of no more than 20 s.f. and 4 feet in height. <br />STAFF RECOMMENDATION; <br />Staff recommends approval of the requested lot area and lot width variances with the condition <br />that the existing shed in the 0-75’ hardcover zoned be removed. Staff can not support the <br />requested side yard variances for new construction since no hardship can be identified. <br />COUNCIL ACTION REQUESTED; <br />Staff requests that the Council take the following action: <br />1. Approve the variances for lot width and lot area with the condition that the existing shed in <br />the 0-75’ hardcover zone be removed; <br />2. Take action regarding the request for side yard variances; <br />3. Direct staff to draft a resolution with the Council’s action for adoption at the March 24,2003 <br />meeting. <br />APPLICANT REQUEST; <br />The applicant is aware of staff s position on the application. The applicant agrees with the <br />Planning Commission’s recommendation with the exception of the 20’ side yard setbacks. The <br />applicant requests that the side yard setbacks be reduced to 15 ’ on either side, as shown in the <br />attached drawings, submitted March 3,2003. The applicant also wishes to present his <br />information to the City Council at the meeting.
