Expand portion of principal structure located 25.1’ from the Oi 1WL of Lake <br />Minnetonka where 75 ’ is required; <br />2. A side yard setback of 6.6’ where 10' is required; and <br />3. A 48.7' encroachment into the average lakeshorc setback. ______ <br />Pertinent Code Sections: <br />1. Section 10.22, Subd. 2 and Section 10.56, Subd. 16(CK1): Sii uctuiH: within 75’: Structures <br />shall be set back a minimum of 75' from the OHWL of Lake Minnetonka (929.4'). (Request: <br />fo allow expansion of the principal .structure located 25.1’ from the OHWL of Lake <br />Minnetonka where 75 ’ is required). <br />2. Section 10.25, Subd. 6 (B): Yard Requirements: The following minimum requirements <br />shall be observed: side yard 10 feet. (Request: To allow a side yard setback of 6.6’ where 10' <br />is required). <br />3. Section 10.22, Subd. 1 (B) and Section 10.56, Subd. 16 (C)(6): Average Lakeshore <br />Setback: The average lakeshore setback line shall be a straight line cotmecting the most <br />lakeward protrusions of the residence buildings on the immediately adjacent lakeshorc lots. <br />(Request: To allow a 48.7’ encroachment into the a\erage lakeshore setback). <br />PLANNING COMIVUSSION: <br />Planning Commission recommended by a 5 to 0 vote as follows: <br />Approv al of the requested variances to reconstruct and expand the roof of the existing principal <br />structure with the follow ing conditions: <br />1. Due to substandard setback of the principal residence from the OHW’L, the applicant <br />must develop an appropriate landscape plan for the lakeside of the residence to mitigate <br />the visual impact of the structure as it is viewed from the lake; and <br />2. If structural removals exceed what is shown on the proposed plans, further review by the <br />Planning Commission and City Council will be required.
