ITie alley was originally dedicated in the <br />plat of Casco Heights in 1911. 'Hie alley is 14 ’ in width and 317.8 ’ in length. The applicant is <br />proposing to vacate only the portion adjacent to his properly. Not the entire distance between <br />Casco Avenue and Casco Point Road. Half of the alley (7’) would go to the applicant and the <br />other 7’ would go to the neighbor to the east, 3721 Casco Avenue. <br />Pertinent Code Sections: <br />1. Section 10.12 (process & standards for vacating streets and alleys) <br />History of application: <br />1 he applicant, Mr. Kail, has another zoning application pending, application #03-2863. This <br />application was heard by the Planning Commission at its February 19, 2003 meeting. The <br />applicant is proposing to construct a new single family residence on the property located at 3753 <br />Casco Avenue. Application #03-2863 is for two variances, lot area and lot coverage by <br />structures. I'he proposed structure was above the allowed 15% lot coverage by structures for new <br />construction. The Planning Commission approved the lot area variance, but denied the lot <br />coverage by structures variance. <br />The application was then heard by the City Council at its February 24, 2003 meeting. The City <br />Council discussed two options to increase the size of the property in order for the proposed <br />structure to meet the 15% lot coverage ordinance: vacating the adjacent alley or purchasing city <br />owned land adjacent to the property. Vacating the adjacent alley is the direction the applicant <br />wished to pursue. Application #02-2863 was tabled in order for the vacation application to be <br />acted on. <br />Neighborhood: <br />•I ^ <br />There have not been any vacations of alleys in the Casco Point area. There have been vacations, <br />but only where the dedicated right of way was between the lake and the residence on the property. <br />» *
