Pertinent Code Sections: <br />1. Section 10.03, Subd. 9(B) & (D): Accessory Building Location & Height: No detached <br />garages or other accessory buildings shall be located nearer the front or street lot line than the <br />principal building on that lot. No acce.ssory building shall exceed the height of the principal <br />building, nor shall it e.xceed 30' in height. (Request: To permit a 408 s.f. detached garage <br />closer to the front property line than the principal residence). <br />Discussion: <br />The survey identifies the footprint of the demolished detached garage. The applicant proposes to <br />rebuild the garage parallel to the existing garage, with 10' in between them, and with a larger <br />footprint (408 s.f. compared to 239 s.f.). <br />Front Setback <br />The front of the lot is defined as that part which abuts the shortest dimension of a public street. <br />Given the odd lot configuration, the shortest dimension on this lot abuts Dickenson Street. With <br />Dickenson Street being the front lot line, the proposed detached garage is located in front of the <br />principal structure. <br />Side and Rear Setbacks <br />Detached garages are required to be located 10' from the side and rear lot lines. The applicant <br />proposes to locate the detached garage approximately 19' from the west side lot line (abutting <br />Russell Avenue) and about 346’ from the rear lot line. <br />Setback from other structures <br />A 10' separation is required between structures on a lot. The applicant proposes to have a 10' <br />separation between the new detached garage and the existing garage. <br />I Icight <br />The height of an accessory structure can not exceed the height of the principal structure. The <br />height of the proposed structure is approximately 11 ’, not exceeding the height of the principal <br />structure. <br />l1i.stoiy: <br />In 1965, a building permit was issued for a 20' x 12' detached garage. Prior to the destruction of <br />the detached garage which is proposed to be rebuilt, two detached garages existed on the <br />property. It was unclear from the information in the street file which of the two detached garages <br />was permitted by the permit. From a review of aerial photographs from 1970, it appears that the <br />garage which still exists on the property today was permitted by the building permit in 1965. <br />Currently within this location, there are also two metal sheds and a canvas covered shed which <br />are not show n on the survey and a detached garage in the process of being resided. A building <br />permit application has not been made for residing the existing detached garage or for the other <br />accessory structures.
