<5 <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE NO. 03-2879 <br />WHEREAS, Gary Hcgenes (hereinafter "the applicant") is the owner of the property <br />located at 2675 Shadywood Road, within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />Tract A, Registered Land Survey No. 1453, files of Registrar of Titles, Hennepin <br />County, Minnesota, (hereinafter "the property"); and <br />WHEREAS, the applicant ha applied to the City for a variance from Municipal <br />Zoning Code Section 10.24, Subdivision 5 (B) to allow a 20.1’ setback where 35’ is required in <br />the side yard adjacent to street setback to consUruct a 330 s.f. (15’ x 22’) single stall attached <br />garage addition to the existing garage, in the LR-1B zoning district; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Plaiming <br />Commission held a public hearing on March 17,2003, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File ^03-2879. <br />Ihc property is located in the LR-IB Zoning District, where 1 acre is the minimum <br />required lot area. The property consists of approximately I acre. <br />3.The Orono Planning Commission reviewed this application on March 17, 2003 <br />and recommended approval by a vote of 5 to 0. <br />4.
