Applicants should be asked for their <br />testimony regarding this issue. <br />Issues for Consideration <br />I.Do the neighborhood impacts of not having sufficient parking available on street or on site <br />act as a h^j'dship that supports the gravel parking area variance? <br />2.Does Planning Commission find any sufTlcicnt hardship to grant the hardcover, average <br />setback and 0-75* structural encroachment to allow the deck on the lake side of the residence? <br />3.Are the staff assumptions correct regarding the nature of the proposed deck south of the <br />house? Are there any valid hardships presented which support the hardcover variance <br />necessary for construction of this deck? <br />4. Other issues raised by the Planning Commission. <br />Staff Recommendation <br />Staff finds no hardship to support a hardcover variance for the deck on the south side of the house, <br />and recommends denial of that request. <br />Staff suggests that while the deck on the west side of the house will have minimal impact on lake <br />views enjoyed by neighbors, and will have minimal visual impact from the lake, there is no apparent <br />hardship supporting the existence of the deck. Staff recommends denial of this request, and removal <br />of the deck within 60 days in addition to whatever measures are required by the Building Code to <br />make the door safe. <br />Staff supports the hardcover variance for the gravel parking area, based on the lack of on-street <br />parking in the neighborhood, and recommends the following conditions of approval: <br />1. Applicant to provide shrubbery between the parking area and the lake for screening of <br />vehicles. <br />2. The parking area be limited to a depth of 25' measured from the edge of the traveled paved <br />road, yielding a 25-30* lake setback. <br />3. The shed next to the lake must be removed by a date certain to be established between <br />Council and applicant, presumably as soon as the snow' is gone. <br />Options for Action <br />1.Recommend denials/approval per staff recommendation and add any additional conditions <br />you feel are appropriate. <br />2.
